Retail Leases and Commercial Leases

You are either one or the other. If your business falls within one of the definitions in Schedule 1 of the Retail Tenancies Act , then your lease will be a Retail Lease.

Being under the jurisdiction of the Retail Tenancies Act gives you certain rights. For example, you cannot be asked to pay for the landlords legal expenses of preparing your lease. You may also have a right for compensation for disturbance.

If it does not appear in the Schedule 1 list then your lease will be a Commercial Lease.
